Euthanasia or Mercy Killing is the act or practice of killing or bringing about the death of a person who suffers from an incurable disease or condition, especially a painful one, for reasons of mercy. The debates over legalizing Euthanasia are not the inventions of today but have erupted during the last few decades of 20th century.
Countries of the world have either legalized voluntary euthanasia or have laid down guidelines and procedures for exercising euthanasia or have responded strongly negative towards the active euthanasia.
In India, too, the socio-medical-legal controversy regarding euthanasia prevailed. However, On 9th March 2018, the Constitution bench of the Supreme Court of India delivered a historic verdict in Common Cause v. Union of India by declaring that Right to live with dignity under Article 21 of the Constitution of India includes Right of a dying man to die with dignity especially in cases of terminally ill patient or a person in Persistent Vegetative State (PVS) where there is no hope of recovery. The court gave legal sanction to Advance Directives or Living Will and issued guidelines for execution and enforcement of Advance Directives.
The Panel Discussion is focused on the development of the right of a dying man to die with dignity. The discussion will also take into consideration the different guidelines issued by the Supreme Court of India for execution and enforcement of Advance Directives or Living Will. The panelists will deliberate on the issues, concerns and preparedness of the State, Professionals and members of society on the execution of the guidelines on Advance Directives.
